Terms & Conditions

These Terms govern your access to and use of Pluvia's platform, website, APIs, dashboards, and data services, operated by Pluvia Pte. Ltd.

1. About These Terms

These Terms and Conditions ("Terms") govern your access to, and use of the Pluvia platform, website, APIs, dashboards, data products, and related services (collectively, the "Services") operated by Pluvia Pte. Ltd., a company incorporated in Singapore ("Pluvia", "we", "us", "our").

By accessing or using our Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you confirm you have authority to bind that organization.

2. Who We Are

Pluvia Pte. Ltd. is a climate intelligence company based in Singapore. We provide hyperlocal rainfall forecasting, flood modelling, and weather data services to customers primarily in Southeast Asia, including governments, insurers, logistics operators, and construction and land management companies.

3. Definitions

4. Access and Accounts

  • You must register an account to access certain features of the Platform.
  • You are responsible for keeping your credentials secure. Notify us immediately at support@pluvia.ai if you suspect unauthorized access.
  • We reserve the right to suspend or terminate accounts that violate these Terms.
  • Users must be at least 18 years old or accessing on behalf of a registered entity.

5. Permitted Use

You may use the Services for your lawful internal business purposes only. Specifically, you may:

  • Access and display Pluvia Data for operational decision-making within your organization
  • Integrate the Pluvia API into your own systems under your agreed license tier
  • Download and store outputs for internal analysis and reporting

6. Prohibited Use

You must not:

  • Resell, sublicense, redistribute, or commercialize Pluvia Data or API outputs without written permission
  • Reverse engineer, decompile, or attempt to extract Pluvia's underlying models or algorithms
  • Use the Services to train competing AI or machine learning models
  • Scrape or bulk-extract data beyond your contracted API call limits
  • Use the Services in any way that violates applicable laws in Singapore or your jurisdiction
  • Represent Pluvia Data as your own proprietary data to third parties

7. API Usage

  • API access is governed by your subscription tier and the call limits specified in your service agreement.
  • Exceeding your allocated call volume may result in throttling, suspension, or additional charges.
  • API keys are non-transferable. You are responsible for all activity under your API key.
  • Pluvia reserves the right to modify API endpoints, data schemas, and rate limits with reasonable notice.

8. Data and Intellectual Property

  • All Data, models, algorithms, forecasts, and platform Content are the intellectual property of Pluvia Pte. Ltd. or its licensors.
  • These Terms grant you a limited, non-exclusive, non-transferable license to use the Data and Services as permitted above.
  • Nothing in these Terms transfers ownership of any intellectual property to you.
  • Pluvia's technology includes proprietary AI/ML models and 15+ years of Southeast Asian climate modelling IP developed in partnership with H2i. These remain exclusively owned by Pluvia.

9. Data Accuracy and Disclaimer

Pluvia uses advanced AI, machine learning, and multi-source data fusion to deliver highly accurate weather intelligence. However:

  • Weather forecasting is inherently probabilistic. No forecast can be guaranteed to be 100% accurate.
  • Pluvia Data is provided as a decision-support tool and should not be the sole basis for critical safety decisions without corroborating information.
  • Pluvia makes no warranty that the Services will be uninterrupted, error-free, or meet your specific operational requirements.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Pluvia's total liability to you for any claim arising from these Terms or the Services shall not exceed the fees paid by you in the 3 months preceding the claim.
  • Pluvia shall not be liable for any indirect, consequential, incidental, or special damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damage.
  • This limitation applies whether the claim arises in contract, tort, negligence, or otherwise.
  • This limitation does not exclude liability for death or personal injury caused by Pluvia's gross negligence or fraud.

11. Service Availability and Maintenance

  • Pluvia targets high platform availability but does not guarantee uninterrupted access.
  • Planned maintenance will be communicated with at least 24 hours' notice where possible.
  • Pluvia is not liable for downtime caused by third-party infrastructure, force majeure events, or circumstances outside its reasonable control (including severe weather events — yes, including rain).

12. Privacy and Data Protection

  • Pluvia collects and processes personal data in accordance with our Privacy Policy, available at pluvia.ai/privacy.
  • We comply with Singapore's PDPA and will take reasonable steps to align with applicable data protection laws in the countries where our customers operate, including Indonesia, Malaysia, the Philippines, Vietnam, Thailand, and Croatia.
  • Where local data localisation or cross-border transfer rules apply, Pluvia may implement region-specific hosting, storage, or processing arrangements as agreed with the Customer.

13. Confidentiality

Both parties agree to keep confidential any non-public information shared during the business relationship, including pricing, technical documentation, and customer data. This obligation survives termination of these Terms for a period of 3 years.

14. Changes to the Services and Terms

  • Pluvia may update these Terms at any time. We will notify registered users via email or platform notice at least 14 days before material changes take effect.
  • Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
  • Pluvia may modify, discontinue, or add features to the Services at its discretion.

15. Termination

  • Either party may terminate a subscription or access agreement in accordance with the notice period specified in your service contract (typically 30 days).
  • Pluvia may terminate or suspend access immediately for material breach, non-payment, or unlawful use.
  • Upon termination, your right to access the Services ceases. Data export requests must be made within 30 days of termination.

16. Territorial Scope and Local Law

  • Pluvia provides Services to Users located in, or operating from, Singapore, Indonesia, Malaysia, the Philippines, Vietnam, Thailand, Croatia, and other jurisdictions where we choose to operate.
  • Users are responsible for ensuring that their use of the Services complies with all applicable local laws and regulations in the countries where they operate.
  • Where local law in a particular country requires additional terms or imposes mandatory obligations, those local requirements shall apply in addition to these Terms.
  • In the event of any conflict between these Terms and non-mandatory local law, these Terms will prevail. In the event of a conflict with mandatory local law, the mandatory local law will prevail only to the extent of that conflict.

17. Governing Law and Disputes

  • These Terms are governed by the laws of the Republic of Singapore.
  • Any dispute arising from these Terms shall first be subject to good-faith negotiation between the parties.
  • Unresolved disputes shall be referred to arbitration under the Singapore International Arbitration Centre (SIAC) rules.
  • The seat of arbitration shall be Singapore, and proceedings shall be conducted in English.

18. Local Variations

  • Pluvia may publish country-specific terms or addenda (for example, for Indonesia, Malaysia, the Philippines, Vietnam, Thailand, or Croatia).
  • If there is a conflict between these general Terms and a country-specific addendum agreed with a Customer, the country-specific addendum will govern for that Customer in that country.
